Terms of Service

General terms and conditions regulate the relationship between the Customer and UPA Kids for any purchase from the website upa-kids.com. The Customer is requested to read carefully the “Terms of Service” and “Privacy Policy” before placing an order.


The domain www.upa-kids.com belongs to Ultimate Products Around Kids Lda., from hereon referred to as “UPA Kids”, registered at the Portuguese Chamber of Commerce with the social security number: 25138120162 and tax identification number: 513812016, residing at Av. João Crisóstomo n.6 6º Esq.,1000-178 Lisboa, Portugal.

UPA Kids owns the intellectual property of the upa-kids.com website and the right to display all the elements of it. Everything on upa-kids.com, including designs, images, drawings, graphics, and text, is protected by worldwide copyright as well as other proprietary laws and treaty provisions. Consequently, total or partial reproduction of the elements contained on the upa-kids.com website, the use of such elements and making them available to third parties is strictly prohibited.

Purchases made at upa-kids.com are subject to the conditions of sale set out in this document and are regulated by Portuguese legislation regarding distance selling.


UPA Kids offers its own unique design products for children. Each product shown by UPA Kids is described in detail and photographed. UPA Kids reserves the right to show all the products as exact as possible but we cannot guarantee that the products seen on screen are the same as in reality. Please note that we reserve the right to alter minor details of the products featured on this site and in other informational materials we provide in the interest of maintaining product quality and design integrity. The birch plywood used in our furniture is a natural product. As such, the colour composition and pigmentation of wood may vary slightly across individual panels. Accordingly, products shipped to you may differ slightly from those depicted on this site or in other informational materials.

The buyer is responsible for the correct assembly of the supplied products following the available instructions.

All the products shown on the upa-kids.com website are subject to the availability at the time of the order. The Customer will be informed if the product requested is not available. UPA Kids retains ownership of the product until the order has been fully paid by the Customer.


All prices on upa-kids.com website are in Euros (€) and include VAT. The prices of the products do not include shipping costs, which will be calculated at the moment of the purchase. Total costs will be indicated in the confirmation of the order.

Sales to the European Union are invoiced with 23% VAT. Sales to countries outside the European Union are invoiced without VAT. If the Customer is resident outside the European Union he/she is responsible for applicable taxes and customs fees according to the country’s policy.

Prices are subject to change without notice, especially in case of special offers, promotions or any other marketing efforts.

UPA Kids does its best to ensure that all pricing information on the upa-kids.com website is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a product shall occur, UPA Kids will allow the Customer the option to confirm the purchase of the Product at the correct price or to cancel the order. If UPA Kids is unable to contact the Customer the order will be treated as canceled.


The price is payable upon placement of the order. The customer undertakes to pay the total price of the products and shipping costs as stipulated on the site and also to pay for the customs duties, the VAT or any other taxes due to the import of products in the country of delivery.

The shipment of our orders is performed after receiving and confirming the payment. We offer the following payment options: Credit Card and PayPal.

UPA Kids reserves its right to claim the return of the ordered products in case of non-payment. Under those circumstances, and upon UPA Kids request, the customer shall return any product for which the payment has not occurred. The customer shall pay for any costs in connection therewith. UPA Kids ships to Europe only. For other locations, please contact us by e-mail to mail@upa-kids.com.

The transportation costs are calculated based on the category of the selected articles, weight, volume, and destination. The cost of this postage is budgeted at the time of purchase in the online store.

The deadlines for receipt depend on the delivery address and range of 7-15 working days, approximately. In no event will UPA Kids be held responsible for delays beyond our control.

Orders for items in our online store are prepared to ship within 14 days of order payment, Monday through Friday from 9h30 to 19h00.

If the product ordered is not available or is out of stock, UPA Kids undertakes to inform the customer as soon as possible and to indicate when the product will be available. The customer may, at its option, wait for the availability of the product or obtain a refund. For more information on these deliveries, please contact mail@upa-kids.com.

Standard Delivery Conditions:

– Deliveries do not include assembly service.

– Products are delivered by a carrier to the address indicated by the customer in the order form.

– In case of absence of the customer at the delivery address, the carrier will leave a reminder and the customer will have a period of 5 days to remove the merchandise at the address indicated in the note.

– In case there isn’t any pickup point in the surroundings of the customer address, the carrier will leave a note with the telephone number the customer should use, in 5 days, to reschedule the delivery.

– Delivery is made with a 24 hours time slot.

– At the reception of furniture, please make sure all the pieces have arrived in good condition. If you detect any abnormalities, make a notation on the bill of delivery.

– In case of doubt or if you have not yet had time to examine the product carefully, note the following on the delivery note: “NEEDS TO BE EXAMINED” along with your signature. Thus, any mishaps that may arise will be solved much faster.

– UPA Kids cannot be held responsible for damage caused during shipment if these instructions have not been respected by the client.

– By confirming these Conditions, the customer agrees to pay postage in case of returns for incomplete or incorrect addresses, as well as shipments not claimed on time.

– If a second shipment is necessary, costs will be charged to the account of the customer. UPA Kids will not be held responsible for the costs derived from second shipments.


In order to avoid any damage to the contents, do not puncture or cut the box open.

UPA Kids will not be held responsible for any damages caused by improper unpacking.


The warranty period of 2 years specified by law applies. In the event of a product default that is covered under the terms of the warranty, we will repair the product, supply a replacement or refund the purchase price at our discretion.

All products on our website are of the highest quality and pass comprehensive and rigorous controls. If a shipment arrives with the appearance of shipping damage or a manufacturing defect, please notify us immediately, within 24 hours, by sending an e-mail to mail@upa-kids.com, and send a description of the damage and photos attached. We will examine the damage and propose tailored solutions that may include replacement of the damaged material or a piece to substitute the damaged one.

If you are not satisfied with the product received you can return it within a period of ten (10) days after the date of receipt. Please contact UPA Kids by e-mail first to arrange the return of the goods. UPA Kids reserves the right to refuse a returned product if the customer has not contacted us beforehand.

Shipping charges are not refundable unless the return is a defective product.

Conditions for returns:

1. Products must not have been used or suffered any damage.

2. They must remain in the original packaging with the original product labels still in place.

Once your return is accepted, you will receive instructions to proceed with the shipment of goods.

The return shipping costs are the responsibility of the customer.

Refunds of the value of products will be made within thirty (30) days after the goods have arrived in our warehouse.

In each order done on the website upa-kids.com, UPA Kids has the right to cancel and proceed to a partial or total refund of the order.

UPA Kids will not be held responsible for the refund or the compensation of products that have been lost, stolen or damaged.


These terms and conditions shall be governed by and construed in accordance with the Portuguese law. Disputes arising in connection with these terms of service shall be subject to the exclusive jurisdiction of the Portuguese courts.
